Square Payroll Employee Terms of Use

By accessing or using Square Payroll (the “Services”) as an employee of one or more Square Sellers that subscribe to the Services (each, your “Employer”), you agree to be bound by the General Terms of Service (“General Terms”), including terms that limit our liability (see Section 18 of the General Terms and require individual arbitration for any potential legal dispute (see Section 21 of the General Terms, these additional terms (“Payroll Employee Terms”), and all other terms, policies, and guidelines applicable to your access to and use of the Services.
1. Access to Services
Access to and use of the Services are available only to persons who are employees of Square Sellers that subscribe to Services. Your Employer, through its subscription to the Services, is providing you with access to the Services under these Payroll Employee Terms. The Services allow you to register your email address and a password in order to receive your paycheck through direct deposit, view your pay stubs and other documents made available by your Employer, and update your bank account, tax withholding allowances, and other personal information used by your Employer to process payroll and calculate your taxes. If you do not have a registered and valid login or are no longer an employee of your Employer, you are not authorized to access or use the Services, except that you may be able to access certain information related to your employment with former Employers for limited purposes.
2. Your Information
You are responsible for determining and accurately providing your personal information, such as your correct mailing address and tax withholding allowances from federal and state tax withholding allowance certificates that you provide directly to your Employer. Your personal information is used to calculate and withhold the correct tax amounts from your pay and to send you your W-2. Therefore, you are also responsible for updating your information when your personal or financial situation changes. You acknowledge that if you fail to accurately provide or update your personal information, your Employer may do so on your behalf. We are not responsible for inaccurate tax withholdings due to incomplete, incorrect, or outdated information. You acknowledge and agree that it is your responsibility to submit information to your Employer and to verify the accuracy and completeness of all such information. You further acknowledge and understand that we do not review the accuracy or completeness of the information that you submit and we are not providing any legal or tax advice by providing the Services. You acknowledge and understand that we are merely making the Services available to you at the request of and on behalf of your Employer. We are not acting as an advisor, agent, or intermediary and are not providing any compensation, benefits, or other information referenced or included in the Services.
3. Payroll Deposits
You may use the Services to set-up receipt of your paycheck from your Employer through direct deposit. Use of the Services is optional and solely for your convenience and the convenience of your Employer. If you choose to receive direct deposits through the Services, you must link a bank account through the Services. You acknowledge and agree that personal and bank account information you provide may be shared with your Employer and used by us to provide the Services to your Employer, in accordance with Square’s privacy policy, and as otherwise required by applicable laws, rules and regulations. In the event that your Employer sends you funds erroneously, you authorize your Employer, either directly or through us, to be refunded an amount not to exceed the original amount of the erroneous credit, which will be debited from your linked bank account.
4. Restrictions
While we want you to enjoy the Services, you may not, nor may you permit any third party, directly or indirectly, to: (a) export the Services, which may be subject to export restrictions imposed by US law, including US Export Administration Regulations (15 C.F.R. Chapter VII); (b) access or monitor any material or information on any Square system using any manual process or robot, spider, scraper, or other automated means; (c) except to the extent that any restriction is expressly prohibited by law, violate the restrictions in any robot exclusion headers on any Service, work around, bypass, or circumvent any of the technical limitations of the Services, use any tool to enable features or functionalities that are otherwise disabled in the Services, or decompile, disassemble or otherwise reverse engineer the Services; (d) perform or attempt to perform any actions that would interfere with the proper working of the Services, prevent access to or use of the Services by others, or impose an unreasonable or disproportionately large load on our infrastructure; (e) copy, reproduce, alter, modify, create derivative works, publicly display, republish, upload, post, transmit, resell or distribute in any way material, information or Services from Square; (f) use and benefit from the Services via a rental, lease, timesharing, service bureau or other arrangement; (g) transfer any rights granted to you under these Payroll Employee Terms; (h) use the Services in a way that distracts or prevents you from obeying traffic or safety laws; (i) use the Services for any illegal activity in any way that exposes you, other Square users, our partners, or Square to harm; or (j) otherwise use the Services except as expressly allowed under these Payroll Employee Terms and the applicable General Terms. If we reasonably suspect that your access to the Services has been used for an unauthorized, illegal, or criminal purpose, you give us express authorization to share information about you and your use of the Services with law enforcement.
5. General Terms
All sections of the General Terms (exclusive of Sections 4 and 10) apply to your access to and use of the Services, including terms that limit our liability (see Section 18) and require individual arbitration for any potential legal dispute (see Section 21). You agree to Square’s Privacy Policy, which explains how we collect, use and protect the personal information you provide to us.
