Square AU Pty Ltd - Credit Authorisation & Additional Privacy Policy Terms

This authorisation (“Authorisation”) is provided by the individual (“You” or “Your”) representing the business (the “Business”) applying to purchase goods through an instalment plan from Square AU Pty Ltd ABN 38 167 106 176 (“Square”).

Collection

You authorise Square and any affiliates or third parties acting on behalf of Square to obtain credit, financial, and related personal or business information and records about the Business or You (including Your consumer credit report and/or Your Business’s credit report) from any credit bureau or credit reporting body from time to time.

The information we collect could include your name, address, date of birth and contact number. Such information is generally provided to us when You or a person within the Business provides information in the course of applying for an instalment plan. Sometimes this information will be collected about you from other people without your direct involvement such as credit reports provided to us by credit reporting bodies (CRBs).

You acknowledge that Your consent will be effective immediately and will continue to be valid for as long as required to fulfil the purposes described in this consent.

You acknowledge that the information obtained pursuant to this Authorisation is subject to Square’s Privacy Policy which can be found at www.squareup.com/ca/en/legal/general/privacy, and the provisions of this Authorisation.

What is “credit information”?

Credit information is personal information that has a bearing on credit. It relates primarily to your credit-related dealings with us in connection with a trade credit application and covers various types of information that we may collect or obtain from Credit Reporting Bodies (CRBs). We provide commercial credit, that is, credit in connection with a business (e.g. a company, partnership or sole trader). We do not provide consumer credit, that is, credit for personal use.

Use

We use the information we collect, including credit information, for the purposes of determining whether an Instalment Plan will be granted to the Business in connection with the Business’s application, to evaluate the ongoing creditworthiness of the Business, to provide services requested by the Business, to confirm any statements, data or other information obtained from or about the Business or You in connection with this application, to perform internal analytics and modeling, and/or for servicing or collections activities.

We may also use your credit information for other purposes such as complying with our legislative and regulatory obligations or otherwise helping us to run our business, including to undertake analyses and modelling of our business and operations. We will not use your credit information for marketing purposes.

The credit information provided to us allows us to perform our functions and activities in establishing, maintaining and administering an Instalment Plan. We may not be able to provide the Business with an Instalment Plan if we cannot collect this credit information

You further acknowledge that Square’s decision to approve or decline the Business’s application for an instalment plan, including information contained in an adverse action notice related to such decision and including references to Your consumer credit report, Your Business’s credit report, and/or other credit-related information, may be shared with the Business and/or certain individuals associated with the Business, for example if they have access to the Business’ Square Account or any email address provided in connection with the Square Account or the application for the instalment plan.

You understand that the name and address of the credit bureau or credit reporting body can be provided to You upon request.

You further acknowledge that the Business requesting an instalment plan may result in a credit inquiry on Your consumer credit report or your Business’s credit report, and that the credit profiles of each report may be affected.

Protection

Credit information we hold about You may be stored electronically in secure data centres located in the United States, Japan, or other countries. We protect credit information about You and the Business with appropriate security measures such as passwords in the case of electronic files, and we require our service providers to do the same.

Disclosure

We undertake a range of tasks in assessing Instalment Plan applications. Some of these tasks may be carried out for us by our third party service providers, both in and outside of Australia, including in the United States, Japan, or other countries. Those third party service providers may have access to Your credit information so we enter into contracts with them to oblige them to use the credit information for the specific role we ask them to perform. We may also disclose credit information to CRBs, to our related corporate bodies or where otherwise required by law.

Credit reporting bodies and Your credit information - notifiable matters

CRBs are permitted under the Privacy Act and the Privacy (Credit Reporting) Code to use and disclose your credit information. Where You or the Business apply for commercial credit (including an Instalment Plan), we may disclose, or collect, credit information about you from a CRB in connection with a trade credit application. Those CRBs may then include such information in credit reports they provide to credit providers to assist those providers in assessing the credit worthiness of You and the Business.

We only deal with the following CRB:

  • Equifax - www.equifax.com.au.

CRBs and fraud: If You think that You have been or are likely to be a victim of fraud, you can request the CRB not to use or disclose credit reporting information about You.

CRBs and pre-screening: Some credit providers can ask CRBs to pre-screen their direct marketing offers for consumer credit by using credit reporting information. You have a right to request a CRB not to use or disclose credit reporting information about You for such purposes.
