Credit Authorisation & Additional Privacy Policy Terms

This authorisation and policy (“Authorisation”) outlines how Square AU Pty Ltd ABN 38 167 106 176 ("Square") manages credit-related personal information. The Authorisation is provided by the individual (“You” or “Your”) representing the business (the “Business”) applying to purchase goods through an Instalment Plan. It is to be read together with our Privacy Policy.

What is "credit related personal information"?

Credit-related personal information is personal information that relates to your credit-related dealings with us in connection with a trade credit application ("Instalment Plan"). Broadly, credit-related personal information includes the following personal information about you:

  • Information that we may disclose to a credit reporting body (CRB);
  • Information that we obtain from a credit reporting body; and
  • Information that we derive from such information, for example, internal credit score.

We provide commercial credit, that is, credit in connection with a business (e.g. a company, partnership or sole trader). We do not provide consumer credit, that is, credit for personal use, although we may collect, use or disclose credit related personal information to help us manage the application for the Instalment Plan.

Collection

You authorise Square and any affiliates or third parties acting on its behalf to obtain credit, information about the Business or You (including Your consumer credit report and/or Your Business’s credit report) from any credit bureau or credit reporting body from time to time.

The information we collect is generally provided to us when You or a person within the Business provides information in the course of applying for an Instalment Plan. This may include identity information, such as your name, address, date of birth and contact details.

We may also collect information about You from credit reporting bodies (CRBs), such as credit reports, information requests about consumer or commercial credit you have applied for, or your credit score.

You acknowledge that Your consent will be effective immediately and will continue to be valid for as long as required to fulfil the purposes described in this consent.

Use and Disclosure

We may hold, use and/or disclose credit related personal information to

  • confirm your identity;
  • assess the Business' application for an Instalment Plan and ability to manage that credit;
  • help manage and/or service the credit provided to the Business, including collecting overdue payments;
  • derive credit scoring, ratings, summaries and evaluations about the Business’ credit worthiness to use in our decision making processes;
  • comply with our legal and regulatory obligations.

We may (as permitted by the Privacy Act 1988 (Cth) and the Credit Reporting Code 2025) disclose your credit related personal information to our legal and financial advisors, and to our related bodies corporate. We will also share your credit related personal information with our CRB, whose contact details are set out below:

We will not use your credit related personal information for marketing purposes.

You acknowledge that Square’s decision to approve or decline the Business’s Instalment Plan application, and any related information such as details from an adverse action notice, Your consumer credit report, Your Business's credit report, and/or other credit-related information may be shared with the Business and/or certain individuals associated with the Business. This could include individuals who have access to the Business' Square Account or any email address provided with the Square Account application.

You further acknowledge that the Business requesting an Instalment Plan may result in a credit inquiry on Your consumer credit report or your Business’s credit report, and Your credit score or credit rating, as calculated by the CRB may be affected.

Overseas Disclosure

We undertake a range of tasks in managing Instalment Plan applications. Some of these tasks may be carried out for us by our third party service providers, both in and outside of Australia. Credit related personal information we hold about You may be transferred to or stored including but not limited to, the United States, Canada, Japan, Ireland, France, Spain and the UK. We protect credit information about You and the Business with appropriate security measures and we require our service providers to do the same.

__Other Notifiable Matters __

When assessing your Instalment Plan we may disclose an information request to Equifax Australia to assess your credit worthiness. Your consent for an information request is not required. In making this information request (or credit inquiry) your consumer credit score or credit rating calculated by Equifax Australia may be affected.

Some of the information that we may disclose to the CRB may affect your credit worthiness, such as where we disclose information on overdue payments or where you commit a serious credit infringement

Equifax Australia may include your credit related personal information in reports to other credit providers, to assist them to assess your credit worthiness.

CRBs and fraud: If You think that You have been or are likely to be a victim of fraud, you can request the CRB not to use or disclose credit reporting information about You.

CRBs and pre-screening: Some credit providers can ask CRBs to pre-screen their direct marketing offers for consumer credit by using credit reporting information. You have a right to request a CRB not to use or disclose credit reporting information about You for such purposes.
