Square for Multi-Legal Entities Terms of Service

Effective Date: 29 October, 2026

These Square for Multi-Legal Entities terms of service (“Multi-Legal Entity Terms”) are a legal agreement between you and Square AU Pty Ltd (ABN 38 167 106 176) (“Square,” “we”, “our” or “us”) and govern your use of the Square for Multi-Legal Entities and related MLE Services (defined below).

Square for Multi-Legal Entities (the “MLE Service”) provides an integrated multi-business management solution that enables a Square account holder (the “Square Account Holder”) of a merchant group to use a single Square Account for multiple legal entities within the merchant group (“Locations”). The "MLE Account" is the single Square Account, controlled by the Square Account Holder in accordance with these Multi-Legal Entity Terms, through which the Square Account Holder and each Location use the MLE Service.

By using the MLE Service, you agree to be bound by these Multi-Legal Entity Terms, the General Terms, the Additional Point of Sale Terms of Service and the Privacy Notice for Square Sellers and Website Visitors. If you are using the MLE Service on behalf of a business, you represent that you have the authority to bind that business or entity to these terms, and you accept these terms as an authorised person on behalf of that business. Unless otherwise defined in these Multi-Legal Entity Terms, defined terms have the same meaning as in the General Terms.

1. MLE Account Creation

To set up the MLE Service, the Square Account Holder must give each Location access to the MLE Account. The Square Account Holder is responsible for ensuring that each person it gives access to is authorised to act on behalf of the relevant Location. The Square Account Holder is responsible for any subscription fees owed to Square for the MLE Service. Each Location is responsible for its own Fees (as defined in Section 4 of the Payment Terms).

We reserve the right to decline the MLE Service to any Square Account Holder or Location, where we determine it is reasonably necessary to protect our legitimate interests. Some sellers may not be eligible for the MLE Service, including sole proprietorships, Locations with non-domestic owners, and events with multiple vendors.

2. Relationship between Square Account Holder and Locations

By joining an MLE Account, you acknowledge and agree that the Square Account Holder has access to and control over (including the right to manage and delete) the MLE Account and all data in the MLE Account, including data associated with any Location. 3. Restrictions and Limitations

In addition to the restrictions in Section 4 of the General Terms, except where prohibited by law, you may not, nor may you permit any third party, directly or indirectly, to use the MLE Service outside of Australia.

You acknowledge that certain Square products and services are not available with the MLE Service, including Square loans and Afterpay for Payments.

4. Disclaimers

The MLE Service provides the ability to use a single Square Account for multiple businesses or locations under the centralized control of the Square Account Holder. The MLE Service does not work for all business models and may not allow you to operate your business in a legally or contractually compliant manner. Square offers no guarantee that the MLE Service is compatible with the rights and responsibilities of Location and Square Account Holder, whether defined by applicable law or any agreement between Location and Square Account Holder. You acknowledge and agree that you are not relying on the MLE Service to satisfy any of your obligations under applicable Commonwealth, State or Territory laws, including but not limited to disclosure, registration, termination, transfer, non-renewal, or privacy requirements. The MLE Service does not create any business relationship between or among a Square Account Holder and Locations . The relationship between the Square Account Holder and any Location is not governed by these terms.

5. Australian Consumer Guarantees

Nothing in these Multi-Legal Entity Terms is intended to exclude, restrict or modify the rights which you may have under Schedule 2 to the Competition and Consumer Act 2010 (Cth) or any equivalent State or Territory legislation (the “Australian Consumer Law”). If you are a consumer, as defined under the Australian Consumer Law, Square acknowledges that the statutory consumer guarantees of the Australian Consumer Law will apply to our supply of goods or services (or both) to you under these Multi-Legal Entity Terms, including in relation to any express warranty we provide. Square’s liability for breach of a consumer guarantee is governed by Section 19 of the General Terms.

6. Term and Termination

You may terminate your participation in an MLE Account at any time. We may terminate your participation in an MLE Account at any time upon providing at least thirty (30) days’ advance notice to you. We may also at any time, acting reasonably, terminate your participation in an MLE Account:

  • in the circumstances specified in Section 7;
  • if you have materially breached these Multi-Legal Entity Terms, the General Terms or any other agreement you have with Square and: (i) the relevant breach cannot be remedied; or (ii) you have failed to remedy the relevant breach within a reasonable period of time, as set out in our notice to you; or
  • if you engage in fraudulent or illegal conduct or any other conduct which is in breach of applicable Laws.

We will notify you reasonably promptly of such a termination, unless our legal obligations or legitimate interests reasonably prevent us from doing so.

The Square Account Holder may terminate the MLE Account at any time, and you will no longer have access to the MLE Account. Each Location’s right to access and use the MLE Service is subject to the Square Account Holder’s ongoing provisioning of access to the MLE Account on the Location’s behalf.

Upon termination of participation in an MLE Account, all historical data shared across the MLE Account will remain accessible to the MLE Account, except as required by law or as necessary to respond to a verified consumer rights request.

7. Disputes Between MLE Account Members

Any disputes between you and any other member of your MLE Account must be resolved directly by you without Square’s involvement. Square may, acting reasonably, take action to resolve a dispute, including, but not limited to, terminating a Location, Square Account Holder, or MLE Account.
