Square Health Terms of Service

By using Square Health and any associated products and services (the “Services”), you agree to be bound by the General Terms, these additional Square Health Terms of Service, and all other terms, policies, and guidelines applicable to the Services you use.
Square provides Sellers with payment processing services only, including the ability to accept and process card and other electronic payments (including gap payments) through Square’s hardware, software, and systems. Square does not provide healthcare claiming services or access to Medicare, private health insurance integrations, or other related health claiming infrastructure. These services are provided separately by Afterpay Corporate Services Pty Ltd (ABN 39 637 140 186) and its third-party integrations (e.g. HealthPoint Claims Pty Ltd and Medicare Online via Services Australia). Square is not responsible for, and does not provide support for, any component of the healthcare claiming process.
You acknowledge and agree that Square does not verify your eligibility to provide health services, your healthcare provider status, or compliance with applicable health or Medicare regulations. It is your sole responsibility to ensure you meet all relevant regulatory, professional and legal requirements.
By using Square’s services in connection with Square Health, you authorise Square to process payments made by customers for health-related services, including any portion not covered by Medicare or private health insurance (“gap payments”). You must not use Square’s payment services to process any rebates or claim-related amounts that are intended to be paid by Medicare, private health insurers, or other third-party payers. Square does not facilitate such transactions and accepts no responsibility for their settlement or processing. You must ensure that all payment transactions processed via Square comply with applicable laws, professional standards, and health services regulations.
You are responsible for issuing all necessary privacy notices and obtaining all necessary privacy consents before submitting any personal information to us, including providing notice and obtaining consent that we may incidentally process sensitive information of customers (e.g., health information recorded on receipts or transaction history).
You acknowledge that Square does not guarantee the availability, accuracy, or reliability of any third-party health platform or claims system integrated through Square Health. Your use of such systems is subject to the applicable third-party terms and conditions.
In addition to any rights Square may have under section 12 of the General Terms of Service and section 36 of the Payment Terms, Square may suspend or terminate your agreement with Square in the following circumstances: (a) if you have violated these additional Square Health Terms of Service or any other agreement you have with Square or any of Square’s publicly available policies and: (i) the relevant breach is material; (ii) the relevant breach cannot be remedied; or (iii) you have failed to remedy the relevant breach within a reasonable period of time, as set out in our notice to you.
