Square Card Digital Wallet Terms
1. These Square Card Digital Wallet Terms
1.1. These Square Card Digital Wallet Terms set out the terms and conditions that apply to your use of the Square Card when you add your Square Card to a Digital Wallet (“Square Digital Card”), and comprise a legally binding agreement between you, the Square Seller business entity that owns the Square Account (“you”, “your”), and Squareup Europe Limited, a company incorporated in England and Wales with company number 08957689, including its successors, affiliates, and assignees (“Square”, “we”, “us”, “our”).
1.2. A Digital Wallet allows you to store a digital version of your Square Card on a device and make payments using that Square Digital Card. Digital Wallets are operated by Digital Wallet providers and are available on supported devices.
1.3. These Square Card Digital Wallet Terms supplement and amend (as the context requires) your existing agreement with Squareup Europe Limited and Squareup International Limited for Seller Services, which comprises the Square Card Terms, General Terms of Service, Payment Terms plus any Additional Terms, such as these Square Card Digital Wallet Terms. In the event of an inconsistency between these Square Card Digital Wallet Terms and the Square Card Terms, General Terms of Service, or the Payment Terms, these Square Card Digital Wallet Terms shall take precedence in relation to your use of the Square Digital Card and the payment services associated with the use of the Square Digital Card.
1.4. Capitalised terms used and not defined in these Square Card Digital Wallet Terms shall have the meanings given to them in the Square Card Terms, General Terms of Service, Payment Terms and / or the Privacy Notice.
2. Application of Terms
2.1 The Square Card Terms continue to apply when you use a Square Digital Card. Anytime we refer to a Card in those terms and conditions, that term includes a Square Digital Card.
2.2. Your Digital Wallet Provider (and other third parties such as mobile network providers or device operating systems) may have separate terms and conditions and privacy policies that they will let you know about when you register for their Digital Wallet or add or use a Square Digital Card. You should ensure that you are happy with all these terms that apply to your use of a Square Digital Card in a Digital Wallet.
3. Digital Wallet Responsibility
3.1. The Digital Wallet Provider is responsible for the operation of the Digital Wallet and we have no control over its operation. We are therefore not responsible for updates, unavailability or performance of a Digital Wallet or a refusal by a merchant to accept a Square Digital Card. If you have questions relating to the Digital Wallet you should ask your Digital Wallet Provider.
4. Adding Square Card to a Digital Wallet
4.1 Where your Square Card is eligible, you can add your Square Card to a Digital Wallet by following the instructions we and the Digital Wallet Provider give you. If we issue you a replacement Card for a Card which was added to a Digital Wallet, you may need to add that replacement Card to the Digital Wallet. You can add your Square Card to a Digital Wallet on more than one device.
4.2. If you have an eligible Card you will be able to add that Card to a Digital Wallet with Digital Wallet Providers we have partnered with. Digital Wallet Providers may have additional limitations or restrictions on who can use a Digital Wallet (for example some Digital Wallet Providers require you to be 16 years of age or older to use their Digital Wallet). You should ensure that you can meet any such requirements before adding your Square Card to a Digital Wallet.
4.3. We may refuse to allow you to add your Square Card to a Digital Wallet for a number of reasons, for example if you have breached the terms and conditions that apply to your Square Card. You can’t add a Card that is cancelled, suspended, blocked or expired. The Digital Wallet Provider may also decline to allow your Square Card to be added to the Digital Wallet and we are not responsible for this.
5. Removing Square Card from a Digital Wallet
5.1 You will need to follow the instructions of the Digital Wallet Provider to remove your Square Card from a Digital Wallet. We may process any payments you made with your Square Digital Card where those payments were approved before your Square Card was removed from a Digital Wallet.
6. Usage
6.1 You can use your Square Digital Card at retailers and merchants that allow you to make payments using your Square Digital Card.
6.2. There may be times when we will not allow you to use your Square Digital Card, for example if your Square Card is suspended or blocked or we have a suspicion of fraud. You will not be able to use your Square Digital Card if you fail to correctly authenticate yourself. The Digital Wallet Provider may also restrict your use of the Square Digital Card for example if you don’t keep to their terms and conditions.
7. Fees
7.1. You will not be charged any fees by Square for obtaining or using your Square Digital Card. You may, however, be subject to third party fees, taxes, or costs relating to the use of your Square Card, such as ATM fees for withdrawal. Digital Wallet Providers may charge you separate fees for their services.
8. Security
8.1. You must keep your security credentials (for example user IDs, passcodes or account passwords) for your device and Square Digital Card secret and not share them with anyone. In particular you should take the following steps at a minimum to keep your Square Digital Card safe:
(a) You should not leave the device you use to access a Digital Wallet unlocked and unattended;
(b) You should use appropriate security on your devices, such as passcodes, passwords, fingerprint or facial recognition and other device security methods;
(c) You should only register your own fingerprint, facial details (or other biometric security credentials) on your device. You must not allow another party use their details (including their fingerprints, facial details or other biometric information), as they may be able to use your Square Digital Card to make payments, for which you may be responsible.
(d) If the fingerprint or facial details (or other biometric security credentials) of another person are used to unlock or make transactions using your Square Digital Card, these will be treated as authorised by you;
(e) You should not disable any security features on your device;
(f) If you are disposing of a device that stores a Square Digital Card, you must first delete the Square Digital Card and any associated information from the device;
(g) You must let us know immediately if a device that stores your Square Digital Card is lost or stolen or if you suspect your Square Digital Card is being used fraudulently by calling us on +44 (0)800 098 8008.
9. Data Protection
9.1. When adding your Square Card to a Digital Wallet, we collect certain information from your Digital Wallet Provider to verify your identity, for fraud prevention and to manage and service your Square Card. When you add your Square Card to a Digital Wallet or use your Square Digital Card, your personal information will be managed by us in accordance with our Privacy Notice.
9.2. We may also share information about your Square Digital Card transactions with a Digital Wallet Provider or card scheme (e.g. Mastercard or Visa) for the reasons set out in their privacy policy and any agreements with you. You should read those documents to understand how your Digital Wallet Provider or card scheme collects and uses your personal information.
10. Changes to these Terms
10.1. We may amend these Square Card Digital Wallet Terms at any time. Revised versions of these Square Card Digital Wallet Terms will be posted to our Square website, effective as of the time it is posted.
10.2. If you do not agree with any such proposed change, you must terminate these Square Card Digital Wallet Terms by removing all Square Digital Cards from your Digital Wallet.
10.3. If you do not terminate these Square Card Digital Wallet Terms, you will be deemed to have accepted such change.
11. Governing Law and Jurisdiction
11.1 This Agreement and any dispute relating to these Square Card Digital Wallet Terms are governed by the law of England and Wales, without regard to choice of law or conflicts of law principles.
11.2 Subject to and without waiver of the arbitration provisions in Section 19 (Arbitration) of the General Terms of Service, you irrevocably agree that the English courts in London, England will have exclusive jurisdiction to settle any dispute, but Squareup Europe Limited and Squareup International Limited are each entitled to apply to any court worldwide for injunctive or other remedies in order to protect or enforce their respective Intellectual Property Rights and/or Confidential Information.
