Frequently Asked Questions

  • Why use contracts?

Using a contract gives you added protection from misunderstandings or fraudulent behaviour that could lead to disputes down the road. They help clarify the terms and conditions before any money is exchanged, building trust with your buyers.

  • How do I create a contract?

Using our contract template, you can write up a new clause (or several), or edit existing clauses to fit your needs. If you save your clauses, you can keep them and reuse them in any contract you make. Select to send your contract to up to 20 recipients at a time and get an e-signature straight to your inbox.

  • Are templates different from contracts?

Yes. A contract template is the basis you can use to create a contract, while a contract is the completed or drafted document you send to a recipient. You can use the template builder to create ready-made templates that can be used to customise contracts for your business.

  • Are contracts legally binding?

We’re happy to offer tools that help improve your business. However, we are not a law firm so we cannot give you any legal advice or legal services. If you need legal advice as to how accurate, sufficient, enforceable or legally binding the nature of your specific contract terms are, you should consult with a qualified legal practitioner.

  • What types of templates does Square offer?

Our contract templates are designed to be between businesses and clients (customers, general contractors, etc).

  • What types of contract templates does Square not offer?

We currently do not offer partnership agreements, rental contracts, leases, subleases, non-disclosure agreements (NDA) or employment contracts between businesses and their employees.

  • What qualifies as a contract agreement?

A contract is a legal agreement between two parties. For a contract to be legally enforceable, several things need to be in place, including mutual agreement, a valid offer and acceptance. Always consult your local laws or seek legal advice to ensure the validity of your contract.

  • Is a verbal agreement a contract?

Different jurisdictions play a large role in determining contract enforcement. If you need legal advice as to how accurate, sufficient, enforceable or legally binding the nature of your specific contracts or agreement terms are, you should consult with a qualified legal practitioner.

  • Are Square Contracts confidential?

Square takes care of handling the security and privacy of all the documents and information uploaded to our world-class secure payments platform so you can rest easy knowing that your money – and your documents – are always safe.

  • Is it free to create contracts?

Yes. You can create and send Square Contracts free of charge.

  • What is the benefit of a digital contract?

Paper can be easily lost, stolen, destroyed or just simply fade with time. Square offers digital contracts that are automatically and safely stored in the cloud, making it easy to keep track of your contracts.
