Add Money Match Contest - Official Rules

To enter this Contest (as defined below), you must agree to and abide by these Official Rules (“Official Rules”).

DESCRIPTION: THIS CONTEST IS NOT OPEN TO THE GENERAL PUBLIC. YOU MUST BE A SQUARE SELLER WITH AN ACTIVE SQUARE CARD TO PARTICIPATE IN THE CONTEST. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. BY ENTERING YOUR BUSINESS IN THE CONTEST, YOU (ON BEHALF OF YOUR BUSINESS AND YOURSELF, AS APPLICABLE) AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING.

1. Sponsor

Square, Inc., 1455 Market Street, Suite 600, San Francisco, CA 94103 (“Sponsor”).

2. Eligibility

The Square Card Add Money Giveaway Content (“Contest”) is not open to the general public. Contest is open to registered bona fide Square Card cardholders; Square Card cardholder must be a legal resident of the United States or the District of Columbia, who is at least 18 years old at time of entry and maintains an active account with Sponsor that is in good standing (“Entrant”). Without limiting the foregoing, Sponsor, and its parent company, subsidiaries, advertising and promotion agencies, and any and all other companies associated with the Contest (collectively, the “Promotion Entities”), and each of their immediate family members (spouse and parent, children, siblings and their respective spouses, regardless of where they reside) and/or people living in the same household, whether or not related, are not eligible to participate. Subject to all applicable federal, state and local laws and regulations.

3. Contest Entry and Selection of Winners

The Contest begins at 6:00 am Pacific Standard Time (“PST”) on Friday, November 20, 2020 and ends at 11:59 pm PST on Sunday, November 22, 2020 (“Contest Period”).

How the Contest Works
  • Entrants can add funds to their Square Card balance by linking a third-party debit card to their Square Card balance (“Add Money Transaction”).

  • During the Contest Period, Sponsor will give away a total of $50,000 U.S. dollars in prizes to winning Entrants (“Winners”).

  • To become a Winner, an Entrant must compete to execute an Add Money Transaction before other Entrants during the Contest Period. Commencing at the beginning of the Contest Period, Sponsor will match up to $250 U.S. dollars for a successful Add Money Transaction executed by each Entrant until Sponsor has successfully issued prizes totalling an aggregate prize amount of $50,000 U.S. dollars (the “Prize”). For example, during the Contest Period, if 1000 Entrants each successfully execute Add Money Transactions in the amount of $250 U.S. dollars, the first 200 Entrants shall be deemed Winners, and Sponsor shall issue a $250.00 U.S. dollars credit to each Winner’s Square Card balance ($250 matching Prize x first 200 Entrants = $50,000 U.S. dollars in total Prizes).

Additional Conditions
  • Each Winner shall be limited to one Prize (with a maximum value of $250 U.S. dollars) for one Add Money Transaction. Additional Add Money Transactions executed by a Winner will not count towards the Prize amount. For example, if a Winner executes three Add Money Transactions in the amounts of $50 U.S., $190, and $10, only the first Add Money Transaction would be eligible for a matching Prize (i.e. Sponsor rewarding a matching Prize on the first Add Money Transaction in the amount of $50).

  • Each Winner shall be limited to one Square account.

  • Sponsor reserves the right to disqualify any Entrant if it determines, in its sole discretion, that such Entrant has attempted to circumvent any of the Official Rules or has otherwise attempted to gain an unfair advantage in the Contest.

4. Winner Selection Criteria

The number of Winners will depend on the number of Entrants and the amounts added through successful Add Money Transactions. Given the finite amount of Prizes available, Winners will be selected based upon the speed with which Entrants execute successful Add Money Transactions commencing from the beginning of the Contest Period.

5. Prizes

Each Winner will receive a Prize amount that matches the amount such Winner added to their Square Card balance via a successful Add Money Transaction, provided, however, that no Prize amount shall exceed $250 U.S. dollars. For example, if a Winner executed a successful Add Money Transaction in the amount of 280 U.S. dollars, such Winner would be awarded a maximum Prize amount of $250 U.S. dollars.

Aggregate Value of all Prizes: $50,000 U.S. dollars.

6. Winner Notification

Winners shall be notified via email on Monday, November 23, 2020. Prizes shall be automatically credited to each Winner’s Square Card balance.

7. Conditions and Limitations of Liability

By participating, Entrants agree to be bound by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects. By participating in this Contest, Entrants agree to release and hold harmless the Promotion Entities as well as each of their respective officers, directors, employees, agents and representatives and each of their respective successors, representatives and assigns (collectively, the “Released Parties”) from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Contest and/or acceptance, receipt, possession or use/misuse of Prize. By entering, Entrants also authorize the Sponsor and its designees to use their name, voice, likeness, photograph, prize information (if applicable), biographical data and city and state of business in programming, advertising and/or promotional material or on a Winners’ list (if applicable) without compensation to the extent permitted by law. Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor’s sole discretion, without obligation or compensation. Contest subject to the laws of the United States only. All federal, state and local laws and regulations apply.

Sponsor and its agencies are not responsible for failed, partial or garbled computer transmissions or for technical failures of any kind affecting the Contest in any manner, including but not limited to electronic malfunction or damage of any network, hardware or software. The foregoing includes any malfunction/error/failure deemed by Sponsor in its sole discretion to impact the administration of the Contest. If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures beyond Sponsor’s control that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right, in its sole discretion, to disqualify any Entrant whether or not the Entrant is a participant in the Contest who tampers with the Contest, and to terminate, modify or suspend the Contest. In such an event, Sponsor reserves the right to conduct the Contest and award the Prizes in a manner which is fair, appropriate and consistent with these Official Rules, as determined by Sponsor in its sole discretion. Notice of termination/modification/suspension of Contest will be emailed to all Entrants. No responsibility is assumed for any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or electronic entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to any person’s computer related to or resulting from participation in or downloading any materials from this Contest. Failure of Sponsor to enforce any provision of these Official Rules shall not constitute the waiver of such provision.

Entrants entering the Contest further agree not to knowingly damage or cause interruption of the Contest and/or prevent others from participating in the Contest. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ENTRANT MAKING SUCH ATTEMPT AND SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW.

8. Disputes

Except where prohibited, Entrant on behalf of his/her business and him/herself personally (as applicable) agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with the Contest or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively through binding arbitration located in the City of San Francisco, State of California, (and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of any kind arising under or relating to these Official Rules), (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest (if any), but in no event attorneys’ fees; and (3) unless otherwise prohibited, under no circumstances will Entrant be permitted to obtain awards for, and entrant on behalf of his/her business and him/herself personally (as applicable) hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. IN AGREEING TO RESOLVE DISPUTES VIA ARBITRATION, ENTRANT UNDERSTANDS AND AGREES THAT THE RIGHT TO A TRIAL BY JURY IN A COURT OF LAW IS BEING WAIVED. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Contest shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules principles (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of California.

9. Personal Information

All information regarding Entrants collected by Sponsor and/or their agents and contractors will be treated in accordance with Sponsor’s privacy policy. Please review Sponsor’s privacy policy here. By entering the Contest, each Entrant agrees that information submitted in connection with the Contest may be used as permitted pursuant to Sponsor’s privacy policy, and otherwise in connection with the administration of the Contest.

10. No Endorsement or Affiliation

This Contest is solely organized and administered by Sponsor, and is not endorsed by or affiliated with Mastercard, Inc. or Sutton Bank in any manner whatsoever.
